Sarma, learned counsel for the applicant and Mr. S. Zaman, learned counsel for the respondents. This I.A has been filed under Section 5 of the Limitation Act, 1963 seeking condoning the delay of 503 days in preferring the connected application under Order IX Rule 4 read with Section 151 of the Code of Civil Procedure for re- admission of the RSA No. 228/2005. It is stated that the grounds for condonation is categorically mentioned in paragraph Nos. 3, 4 and 5 of the of delay condonation petition. I have perused the same. Page No.# 4/4 Subsequently, the applicant collected the contact number of the engaged counsel and the matter was handed over to him on 05.08. 2019 and same was handed over to the son of the applicant on 31.07.1919 by the earlier engaged counsel. Since the legal heirs of the deceased appellant were already substituted, an application under Order 9 Rule 4 of the CPC was filed for setting aside the order dated 21.05.2017 passed in RSA No. 228/2005. It is submitted that the delay has been caused due to lack of knowledge about the dismissal of the RSA No. 228/2005 on the part of the present applicant. The learned counsel for the respondents has submitted that the matter attained finality and the same should not be reopened at this stage. Having regard to the grounds stated above by the appellant /applicant supported by an affidavit and in view of the fact that the applicant is able to show sufficient causes for condoning the delay, the delay is condoned.
