JUSTICE RAJESH MAZUMDAR ORDER Date : 14.03.2026 Ms. Nena Haflongbar, Assistant Manager of the New India Insurance Assurance Company Ltd. (Insurance Company) is present. Smt. Maromi Chinte and Rahul Chinte are present. It has been submitted today that Ms. Priyanka Chinte, Shri Manager Chinte and Smt. Dubori Chinte i.e., respondent Nos. 2, 4 and 5 have expired. A sum of Rs. 4,44,000/- had been granted by the Tribunal along with interest @ 6% per annum Page No.# 3/3 from the date of filing of the claim. Today, the parties have arrived at a settlement of Rs. 4,44,000/- along with interest quantified at Rs. 4,12,920/-. The insurers had already paid Rs. 2,22,000/- in view of the orders of the High Court. Thus the insurer will now deposit the balance of Rs. 2,22,000/- as principal and the interest amount Rs. 4,12,920/- minus the TDS to the Registry of the Court, within a period of 45 days from today, in which event the settled amount shall not carry any further interest. If there is a delay beyond 45 days, the statutory interest would apply. The settled amount shall be released to the respondent No.1 on proper identification. The respondent No. 3, who is also the claimant No.3 in the original claim petition expresses absence of any objection, in case the entire amount along with the interest is released to the respondent No.1/claimant No.1 in the original claim petition. The statutory amount which was deposited at the time of filing of the appeal be refunded to the appellant company after the settlement is satisfied by payment before the Registry of this Court.
