(WPS No.5415/2019) CGHC010242012019 2026:CGHC:34244 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 5415 of 2019 Meena Sahu, W/o Late Shri Rajesh Sahu, D/o Shri Gokul Prasad Sahu, Aged about 27 years, R/o Village Bijari, Post Office Porda, Police Station & Tehsil Gharghoda, District Raigarh, Chhattisgarh. ... For Respondents No.5 & 6 : Mr. Vinod Deshmukh, Advocate. Single Bench:- Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 05/08/2026 SISTA SOMAYAJULU Digitally signed by SISTA SOMAYAJULU Date: 2026.08.06 10:46:30 +0530 (WPS No.5415/2019) 1. This petition is directed against the order Annexure P-1 dated 5-3- 2019, by which the petitioner’s application for grant of employment in lieu of acquisition of her father-in-law’s land has been rejected. 2. Mr. Surfaraj Khan, learned counsel appearing on behalf of the petitioner, would submit that the order impugned is unsustainable and bad in law. 3. Mr. Vinod Deshmukh, learned counsel appearing on behalf of the SECL/respondents No.5 & 6, would submit that the petitioner’s husband Rajesh Sahu was son of Sunderlal, whose one son Rakesh Kumar has been granted employment on 9-9-2019 and it is also reflected in Annexure R-5/2, therefore, the writ petition deserves to be dismissed. 4. I have heard learned counsel for the parties and considered their rival submissions made herein-above and also gone through the record with utmost circumspection. 5. A careful perusal of the record would show that it is clearly recorded that in lieu of the acquisition of land of Sundarlal, S/o Mayaram; Bhuvneshwar, S/o Mayaram; and Rameshwar, S/o Mayaram, total 5.57 acres, Sitaram, S/o Rameshwar and Rakesh Kumar, S/o Sunderlal have already been granted employment by orders dated 11- 9-2019 and 9-9-2019, respectively, and in lieu of acquisition of 2.89 acres, separate employment has been created. 6. In that view of the matter, since the brother of the petitioner’s husband namely Rakesh Kumar has already been granted (WPS No.5415/2019) employment in lieu of acquisition of land, I do not find any merit in this writ petition, it deserves to be and is accordingly dismissed. No order as to cost(s). Sd/- (Sanjay K. Agrawal) Judge Soma
