This appeal has been filed by the appellant/claimant under Section 173 of the Motor Vehicles Act, 1988 (for short “Act of 1988”) seeking enhancement in the compensation amount awarded by the impugned award dated 10.04.2019 passed by the Additional Motor Accident Claims Tribunal, Katghora, District Korba, Chhattisgarh (for short “Claims Tribunal”) in Claim Case No. 66/2017, whereby the Claims Tribunal allowed the claimant’s application and awarded compensation to the tune of 30,000/- along with interest. ₹ 2. Mr. S.R.J. Jaiswal, learned counsel for the appellant/claimant, would submit that the Claims Tribunal erred in awarding the less amount. He would also submit that under the heads of nutritious food and transportation 10,000/- each, is liable to be enhanced. ₹ 3. Mr. Utsav Mahiswar, learned counsel for he Insurance Company, would oppose the prayer made by learned counsel 3 MAC No. 1443 of 2019 for the appellant and submit that the compensation amount awarded by the Claims Tribunal is just and proper and the same does not call for interference. 4. Having heard learned counsel for the parties, considered their rival submission made herein above and after going through the records, this Court is of the considered opinion that ₹10,000/- under the head of nutritious food and 10,000/- ₹ under the head of transportation are liable to be enhanced, as such, total 20,000/- ₹ , is enhanced by this Court in the compensation amount awarded by the Claims Tribunal to make it just and proper, meaning thereby the total compensation amount would be 50,000/- ( 30,000 + ₹ ₹ 20,000/-). However, the other direction contained in the impugned award shall remain as it is and the same is applicable on the amount enhanced by this Court. 5.
