1. This appeal has been filed by the appellant/Insurance Company under Section 173 of the Motor Vehicles Act, 1988 (for short “Act of 1988”) against the impugned award dated 18.06.2019 passed by the 1st Additional Motor Accident ANKIT KUMAR SINGH Digitally signed by ANKIT KUMAR SINGH
2 MAC No. 2162 of 2019 Claims Tribunal, Raigarh, Chhattisgarh (for short “Claims Tribunal”) in Claim Case No. 49/2018, whereby the Claims Tribunal allowed the claimant’s application and awarded 2,72,000/- along with interest. ₹
2. Mr. Dashrath Gupta, learned counsel for the appellant, would submit that compensation amount awarded by the Claims Tribunal is on higher side which is liable to be reduced.
3. Mr. Amit Sharma, learned counsel for respondent No.1, would oppose the prayer made by learned counsel for the appellant and submit that just and proper compensation amount has been awarded by the Claims Tribunal which does not call for interference.
4. Having heard learned counsel for the parties, considered the
facts and circumstances of the case and after going through the records, I am of the considered opinion that the compensation amount awarded by the Claims Tribunal is not on higher side and same is just and proper, as such, I do not find any merit in the instant appeal and accordingly, the same is dismissed. No cost(s). Sd/-
