We have heard Ms. Archana Patel, learned counsel appearing for the appellant and Mr. P.V. Patadiya, learned counsel appearing for the respondent. 2. This first appeal under Section 19 of The Family Courts Act, 1984 is directed against the dismissal of the divorce suit filed by the husband, appellant herein. 3. Pending the appeal, the parties have settled their dispute amicably. Both the counsels have jointly tendered a notarized settlement deed which is ordered to be taken on record. 4. The parties are present before this Court. On inquiry, they have accepted the terms and conditions of the settlement deed and further affirmed that, by way of settlement, they have decided to dissolve their C/FA/5655/2019(GJHC240754982019) ORDER DATED: 24/08/2026 marriage for which they will file an application under Section 13(B) of Hindu Marriage Act, 1955 for getting divorce by mutual consent. The appellant-husband has handed over the demand draft of Rs.18,51,000/- drawn in favour of the respondent-wife and copy thereof is being attached with the settlement deed. In such circumstances, the permission, as sought for filing an application for mutual divorce before the Family Court, Ahmedabad, is granted. The Family Court shall decide the petition for mutual divorce as expeditiously as possible. The respondent-wife shall cooperate with the proceedings. She has made a statement by assuring that, she will file an affidavit for mutual consent divorce and shall adhere to the terms and conditions of the settlement deed. 5. In such circumstances, the settlement of the parties in terms of settlement deed is hereby recorded and we are satisfied that the parties have entered into settlement voluntarily. 6. Thus, therefore, the appeal stands disposed of in view of the terms and conditions of the settlement deed. The parties shall adhere to the terms and conditions of the settlement deed. (ILESH J.
