The 1st Additional Motor Accident Claims Tribunal & 1st Additional District Judge, Raipur, Chhattisgarh (for short “Claims Tribunal”) passed the impugned award on 13.04.2007 against which the present appeal under Section 173 of the Motor Vehicles Act, 1988 (for short “Act of 1988”) has been preferred by the appellant/claimant on 21.01.2019 with a delay of 4211 days i.e. almost 12 years. 3. After going through the applications for condonation of delay, the only reason for delay assigned is that the appellant was minor at the time of passing of impugned award, however, it is apparent from the record that the appellant herein was duly represent through his father Umesh Prasad Verma. Therefore, considering the fact that the appellant was duly represented through his father Umesh Prasad Verma before the Claims Tribunal and within one year from the date of passing the award he became major, as such, no sufficient reason has been assigned by the appellant for the inordinate delay of about 12 years in filing the instant appeal. In that view of the matter, I do not find any good ground to condone the inordinate delay of 4211 days i.e. almost 12 years in filing the instant appeal, as such, the applications for condonation of delay is rejected and consequently, the appeal is dismissed.
