The petitioners were an applicant and candidates for the post of Teacher (Panchayat) for which recruitment was issued on 07.10.2016 (Annexure P/2), however the said post was absorbed in the Department of Education. 2. Mr. R.S. Patel, learned counsel for the petitioner, would submit that the petitioners were participated in the recruitment process and the merit list was prepared for the post of Teacher (Panchayat), therefore, respondent authorities may be directed to finalize the recruitment process and grant the appointment order to the petitioners on the post of Teacher (Panchayat). 3. Mr. Rahul Tamaskar, learned State counsel, would submit that pursuant to decision taken by the Cabinet recruitment 3 WPS No. 2661 of 2019 process has been stayed vide order dated 18.06.2018 & 30.06.2018 and thereafter, the post of the Teacher (Panchayat) has been absorbed in the Department of Education, therefore, the recruitment process could not be finalized. 4. I have heard learned counsel for the parties, considered their rival submissions made herein-above and gone through the records with utmost circumspection. 5. Admittedly, the subject recruitment was stayed by the Cabinet on 18.06.2018 which has been followed by the Government on 30.06.2018 and, as such, the subject recruitment has already been stayed by orders dated 18.06.2018 & 30.06.2018 which has not been questioned by the petitioners in this writ petition. More particularly, the post of Teacher (Panchayat) has already been absorbed into the Department of Education.
