Learned counsel for the petitioner submits that pursuant to the order passed by this Court in WP. No. 15045 (W) of 2017 titled as Rabindra Ganai – vs – The State of West Bengal & Ors.. the proceedings were held before Block Development Officer, Murshidabad, Jiaganj Development Block. 2. Learned counsel submits that concerned Block Development Officer after conducting the proceedings vide order dated 15th May, 2018 as inter alia held that respondent No. 6 has been forcefully occupied 270 sq. ft. comprising the godown of the petitioner Rabindranath Ganai and is liable to be evicted from the portion of the suit land. 3. Learned counsel submits that however this order has yet not been implemented. 4. Learned counsel for the State and the private opposite party submits that it is a civil dispute which could not have been agitated before the Block Development Officer. 5. Be that as it may be, as per record this enquiry report of BDO has not been challenged as yet by any of the parties. 6. The representation dated 29th November, 2019 of the petitioner for implementation of this order is still pending before BDO Murshidabad, Jiaganj Development Block, Lalbagh, Murshidabad and the Prodhan, Prasadpur Gram Panchayat. 7. Let this representation be decided within six weeks after giving opportunity to all the concerned parties of being heard. All the contentions are kept open to be agitated before the competent forum. 8. Block Development Officer, shall communicate this decision within two weeks to the concerned office. 2 9. Learned counsel for the petitioner submits that in view of this it would not press this petition further with liberty to take appropriate legal steps in accordance with law. 10. This petition is disposed of. 11. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities..
