GP FOR EDUCATION (AP) The Court made the following: 3 VS,J W.P.No.48034 of 2018 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “to issue an appropriate Writ, Order or Direction more particularly one in the nature of writ of Mandamus to declare the action of the 5th Respondent in not taking steps for providing Employment to the petitioner on out sourcing basis in pursuance of the recommendations made by the 4th Respondent in Lr. Rc. No. 11012/C3/2018 dated 25-09-2018 as illegal, arbitrary and violative of Article 14 of the Constitution of India and consequently direct the Respondents to provide suitable employment to the petitioner on out sourcing basis in pursuance of the recommendations made by the 4th Respondent in Letter LR. Rc. No. 11012/C3/2018 dated 25-09-2018 and to pass” 2. The petitioner, having completed M.A., B.Ed., (Urdu) and I.T.I., addressed a letter to the then MLA of Yemmiganur with a request to provide any suitable job on temporary basis or on outsourcing basis, pursuant to which, the concerned MLA addressed a letter to the 3rd respondent recommending the petitioner for any source of employment and accordingly, the 2nd respondent vide proceedings in Rc.No.1693/Estt.IV/2018, dated 08.08.2018 directed the 4th respondent to take necessary action. The 4th respondent forwarded the said proceedings to the 5th respondent vide letter dated 25.09.2018 for further action, but, till date, no such action was initiated. Hence, the present petition is filed. 3. The 5th respondent has filed a detailed counter affidavit stating that pending the present petition, the petitioner has filed W.P.No.11865 of 2019 seeking a direction to the 5th respondent to take steps pursuant to the letter addressed by the 4th respondent for providing suitable employment to the 4 VS,J W.P.No.48034 of 2018 petitioner. The said writ petition was disposed of on 22.08.2019 with the following direction: “Hence, in the above circumstances, this court deems it fit to direct respondent No.5 to dispose of the representations of the petitioners dated:02-06-018 and pass appropriate orders within a period of four weeks from the date of receipt of a copy this order.” 4. It is further stated in the counter affidavit that pursuant to the aforesaid order, the petitioner submitted an application on 03.10.2019 to consider her for appointment to the post of Part Time Instructor (Work Education); the respondents, after examining the said application as per the guidelines issued in proceedings Rc.No.271/APSSA/A9/2014 of the State Project Director, APSSA, Hyderabad, rejected the petitioner’s application by directing her to apply as and when a notification is issued by the School Level Committee for selection of Part Time Instructor vide proceedings Rc.No.406/A4/2017, dated 28.10.2019 and Rc.No.1809/PRT/A4/2020, dated 30.06.2020 of the 5th respondent. 5. Heard learned counsel for the petitioner and learned Government Pleader for Education. 6. Perused the entire material available on record. During the course of hearing, it is brought to the notice of this Court by the learned counsel for the respondents that aggrieved by the proceeding dated 28.10.2019, by way of which the petitioner’s application was rejected, the petitioner filed W.P.No.25131 of 2022 before this Court which is pending for adjudication. In 5 VS,J W.P.No.48034 of 2018 view of the subsequent developments took place in the present case, this Court is of the opinion that the cause in the present writ petition does not survive for further adjudication. 7. Accordingly, this writ petition is closed. However, the petitioner may take steps in adjudicating the case pending before this Court, if so advised.
