None appears for the petitioner though the matter is called thrice over. 2. Considering the health condition of the petitioner as was reported, the following order was passed in 16.03.2026: “1. The matter was presented before this Court on 01.10.2018. Thereafter Stamp Reporting was done and certain defects were pointed out. The defects have not been removed, the matter has not been listed and no steps have been taken. 2. From Annexure-1 of the petition, it is apparent that the petitioner was unfortunately suffering from cancer and she was being treated at Tata Memorial Hospital. Annexure-1 is copy of the medical advice issued by the Professor of Department of Medical Oncology, Tata Memorial Hospital dated 12.04.2017. 3. The Registry shall send intimation to the petitioner in her given address along with copy of this order indicating the next date of listing to be 06.04.2026. The matter shall be listed on the said date. 4. The learned Additional Government Advocate is requested to enquire through the opposite party no.2 who in turn shall get information from the opposite party nos.3 and 4. 5. List on 06.04.2026.” 3. Thereafter, the said order was reiterated on 06.04.2026. Both the orders were communicated as directed by the Registry and Registry of this Court through the learned District Judge has made efforts to serve the notice. The process server went on 26.04.2026 to serve the copy of the orders at the given address, to make the petitioner aware. 4. The report of process server has been forwarded duly countersigned by the Deputy Administrator, Process Establishment Section, District Judge Court, Cuttack, placed on record marked at Flag ‘A’. The service report is signed by the two witnesses. The Process Server has made all the efforts to find out the house of the petitioner, contacted her husband staying at Bhubaneswar who has informed that the petitioner has unfortunately passed away in the meantime. 5.
