CORAM:
THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA
Order No.
ORDER 17.02.2026
02.
1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned Additional Government Advocate for the State- Petitioners as well as Mr. S.Routray, learned counsel appearing for the Opposite Parties.
3. By filing the present Review Petition, the State-Petitioners seeks for review of order dated 20.11.2015 passed in F.A.O. No.553 of 2013 by a Single Judge Bench of this Court.
4.
Learned counsel appearing for the Opposite Parties at the outset raised objection with regard to the maintainability of the present review petition. In course of his submissions, learned counsel for the Petitioners referred to the order passed by a Coordinate Bench in State of Odisha & Ors. vs. Martha Pradhan & Ors. in RVWPET No.229 of 2018 decided on 28.10.2025. On perusal of the aforesaid order passed by the Coordinate Bench, this Court found that the Review Petition is

25.08.2025.
5. On perusal of the judgment in Sri Sugyan Choudhury vs. State of Odisha & Ors. in RVWPET No.234 of 2012 and a batch of other similar Review Petitions disposed of vide judgment dated 25.08.2025, this Court found that the learned Coordinate Bench has delivered elaborate judgment and eventually concluded that the Review Petition is not maintainable. On perusal of the said judgment, it appears that a specific issue was framed with regard to maintainability of the Review Petition. In Para-4.1.(a), the aforesaid question has been answered by the Coordinate Bench and eventually in the concluding paragraph it has been held that the Review Petition being devoid of merit and also lacks maintainability and is liable to be dismissed. Accordingly, the same was dismissed.
6. In view of the aforesaid position of law, this Court is of the view that the judgment of the Coordinate Bench is binding on this bench. Hence in terms of the judgment dated 25.08.2025 passed in Sri Sugyan Choudhury’s case (supra), this Court holds that the present Review Petition is not maintainable. Accordingly, the same is dismissed. However, liberty is granted to the State-Petitioner to seek further remedy before any other forum, if so advised.
