By means of this application, the Petitioners seek the following relief: “Therefore it is prayed that before this Hon’ble Court may graciously be pleased to allow this writ petition issue notice to the Opp.parties call for the records after hearing both the sides this Hon’ble Court may direct to restrained to enter into the case land fill disposal of the case. And may direct to the opp. party No. 2 and 3 to consider the matter and reopen the mater vide M.C. No. 944/88 visualize thoroughly to set aside the matter.;” 3. The learned counsel for the Petitioners though has not explained the reason for which the defects pointed out by the Stamp Reporter has not been removed so far. On merits, it was submitted that the matter is in controversy with regard to the ownership of the property which is lying over in a suit before the competent court of law at Sambalpur. 4. Having regard to the aforesaid submissions of learned counsel for the Petitioners, and considering that the court in seisin over the matter has jurisdiction to adjudicate upon the matter relating to injunction as prayed for, no further cause survives for this Court to entertain the present writ petition. 5. Hence, the same is disposed of with a liberty to the Petitioners to ventilate his grievance through appropriate application before the Civil Court.
