By means of this application, the Petitioner seeks the following relief: “The Petitioner therefore prays that your Lordship may graciously be pleased to admit this writ petition and issue notice to the Opposite Parties to file their show cause as to why this writ application shall not be allowed and after hearing counsel from both sides this Hon’ble Court kindly issue a writ in the nature of a writ of “Mandamus” directing the Opposite Parties especially the Opposite Party No. 4 i.e., B.D.O., Basta not to allow the Opposite Party No. 6 to construct house under “Pradhan Mantry Abas Yojana” over plot No. 10 of Mouza-Gahirasimilia bearing Hal khata No. 313/13 measuring an Area of Ac. 15dec. of Kisama Gahira vide Annexure-1 for the ends of Justice and equity and the Petitioner further prays that direction may be given to the Opposite Party No.6 to construct the said house under “Prime Minister Abas Yojana” over an Homestead land of his own for the ends of Justice and equity. ;” 4. The matter is lying over for removal of defects since 2018, yet no step has been taken for the removal of defects despite the same.
