The matter is pending since 2018, presented before this Court on 17.08.2018. The petitioner appearing in person was heard by the coordinate Bench and notices were issued on 7.12.2018 by registered post with A.D. directing requisites to be filed by 12.12.2018 as undertaken by the petitioner appearing in person. Coordinate Bench by the said order further directed that the matter to be listed after service return from opposite parties 2 to 8. 2. Pursuant to the order, petitioner remains in default in not filing the requisites as noted by the Registrar (Lawazima) dated 4.3.2020. The said Stamp Report/office note is reiterated by the latest office note dated 26.2.2026. 3. Learned AGA referring to the averments made in the petition submits that the petitioner in the year 2018 was seeking transfer of G.R. Case No.1691 of 2017 arising out of ICC Case No.74 of 2017 then pending in the court of learned S.D.J.M., Sambalpur to be transferred to any other court i.e. (C.J.M., Sambalpur, Civil Judge (Junior Division)-J.M.F.C., Sambalpur). Learned AGA submits that the prayer made is for transfer within same session for which as per the provisions contained in section 407 Cr.P.C. (since repealed and substituted by pari materia provision contained in section 477 of the BNSS, 2023), petitioner should have moved the learned Sessions Judge, Sambalpur. 4. With passage of time apparently nothing survives for adjudication in the present matter. The petition stands disposed of. 5. Copy of this order shall be forwarded by the Registry to the court of learned S.D.J.M., Sambalpur to be tagged to the case records of G.R.
