The Petitioner-husband in the marriage is before this Court challenging the order dated 28.11.2017 passed by the learned Judge, Family Court, Bargarh in I.A No.17 of 2016 arising out of MAT. Case No.26-30- 144 of 2016. 3. The I.A was filed under Section 24 of the Hindu Marriage Act, 1955 during pendency of the MAT. Case seeking maintenance pendente lite for the wife in the marriage as well as the minor child then aged about 5 years. The matter is pending since 2018. 4. From the order sheet available, it is apparent that after the matter was presented before this Court on 18.01.2018 it has never been listed. 5. Today the matter being in the list, a memo is filed by the learned counsel for the Petitioner which states thus: “xxx xxx xxx That the Petitioner does not want to press the present writ petition & humbly submits to dispose of the writ petition as “Not pressed”. xxx xxx xxx” 6.
