The present writ petition has been filed under Article 226/227 of the Constitution of India with a prayer for issuance of an appropriate writ or order in the nature of certiorari for quashing the action of respondent No.3 vide which seven posts out of ten reserved for physically handicapped have been filled up from General Category posts where six posts of General category and four posts from SC category were advertised for the said category as per advertisement dated 16.02.2016 (Annexure P-1) and corrigendum dated 29.04.2016 (Annexure P-2). Moreover, as per the reservation policy dated 15.07.2014 (Annexure P-6), the reservation for persons with disabilities have been allowed horizontal which cuts across vertical reservation but respondent No.3 without considering the reservation policy (Annexure P-6), recommended/selection 7 PH-Ortho candidates against 55 posts advertised for general category whereas 3% horizontal reservation has been allowed for persons with disabilities under the reservation policy. Further respondent No.3 may be directed to recommend the name of petitioners for appointment to the post of Assistant Professor Math HES-II against the posts advertised for General Category candidates as they secured 65.67 and 65.34 marks respectively and fall in the zone of selection as is clear from the result (Annexure P-4) and result/merit (Annexure P-5). Further respondents be directed not to issue appointment orders to nine candidates selection against posts advertised under Economically Backward Persons (General) as this Court has passed interim order dated 07.12.2017 (Annexure P-7) wherein notification regarding reservation for EBP category has been ordered not to give effect. 2. The case was called twice; however, despite the matter having been taken up on both occasions, none appeared on behalf of the petitioners to prosecute the present writ petition. Even on the last date of hearing i.e. 04.12.2023 there was no representation on behalf of the petitioners. It appears that the petitioners are no longer interested in pursuing the present proceedings. Consequently, the present writ petition is dismissed for want of prosecution.
