(ii) FIR No.32 dated 06.10.2018 registered at Police Station Patara, District Jalandhar (Rural) under Sections 302, 201, 34 IPC; & (iii) FIR No.214 dated 25.10.2018 registered at Police Station City Phagwara, District Kapurthala, under Sections 420, 34 IPC.
Learned counsel for the petitioner submits that in FIR dated 03.08.2018, the petitioner has been acquitted 09.04.2021 passed by learned Sessions Judge, Jalandhar. So far as FIR No.32 dated 06.10.2018 submitted that though the petitioner was found innocent investigation, however, he was summoned under Section 319 Cr.P.C., vide order dated 15.12.2022 the Additional Sessions Judge, Jalandhar. The 15.12.2022 was challenged by the petitioner by way of CRM allowed by this Court vide order dated 17.11.2023 summoning order dated 15.12.2022 was set aside. With regard to FIR No.214 dated 25.10.2018, a cancellation report has been filed by the police accepted by the trial Court vide order dated 22.12.2020 (Annexure P In view of the aforesaid subsequent developments, l counsel for the petitioner submits that the petitioner may be permitted to withdraw the present petition with liberty to file a detailed representation FIR No.32 dated 06.10.2018 registered at Police Station Patara, District Jalandhar (Rural) under Sections 302, 214 dated 25.10.2018 registered at Police Station City Phagwara, District Kapurthala, under Sections 384,
Learned counsel for the petitioner submits that in FIR No.85 acquitted, vide judgment dated 09.04.2021 passed by learned Sessions Judge, Jalandhar. FIR No.32 dated 06.10.2018 is concerned, it has been the petitioner was found innocent during he was summoned to face trial as an additional vide order dated 15.12.2022, passed by . The said summoning order dated by the petitioner by way of CRM-M-4932-2023, allowed by this Court vide order dated 17.11.2023, whereby the summoning order dated 15.12.2022 was set aside. 214 dated 25.10.2018, learned counsel has been filed by the police, which was 22.12.2020 (Annexure P-8).
