1. Instant petition has been filed under Section 482 Cr.P.C. (corresponding to Section 528 of the BNSS, 2023), seeking quashing of the impugned order dated 13.04.2018 (Annexure P-1), passed by the learned Additional Sessions Judge, Jalandhar, in Criminal Revision No.180 of 2018, titled "Avtar Kaur versus Harminder Singh and others", arising out of FIR No.08, dated 07.09.2010, registered under Sections 406, 420, 448, 380, 511 and 120-B IPC at Police Station NRI, Jalandhar, whereby the revision petition filed by the complainant against the dismissal of an application under Section 311 Cr.P.C. was allowed and, consequently, the application under Section 311 Cr.P.C. filed by the prosecution in case No.85357/2013, titled "State versus Harminder Singh and others", arising out of the aforesaid FIR, was also allowed. 2. In the present case, while issuing notice of motion vide order dated 24.04.2018, the learned trial Court was directed to adjourn the proceedings beyond the date fixed by this Court. 3. There was no representation on behalf of either of the parties on
28.07.2025. It was recorded on the said date that the case had been listed pursuant to the orders of Hon'ble the Chief Justice under the Special Mediation Drive, namely, "For Referral to the Special Mediation Drive – Mediation 'For the Nation'", for exploring the possibility of an amicable settlement through mediation. However, nobody put in appearance on behalf of any of the parties to express consent for referring the matter to mediation. 4. Even today, when the case is taken up for hearing, the position is no different, as there is no representation on behalf of the petitioners. 5. Accordingly, present petition is dismissed for non-prosecution. Let a copy of this order be forwarded to the learned trial Court concerned for proceeding further with the trial, in accordance with law. Pending misc. application(s), if any, also stand(s) disposed of.
