1. The petitioner has filed the instant petition under Articles 226 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the order dated 23.02.2018 (Annexure P-11), passed by the respondents. Further, seeking issuance of a writ of mandamus directing the respondents to count the services rendered by the petitioner from 03.07.1972 to 21.05.1985 with the Beas Construction Board as well as in BBMB Talwara Township on temporary and adhoc (Regular) basis for the purpose of pension and other retiral benefits along with the services rendered by the petitioner since 21.05.1985 to 31.03.2012. Further, to fix the pay (initial) of the petitioner w.e.f. 21.05.1985 i.e. the date of initial joining according to Rule 4.4(b) of Punjab CSR Vol.1, Part-1 as per last pay drawn by the petitioner on 21.05.1985 with the BBMB and to grant him arrears of pay as well as arrears of pension and other pensionary benefits.

Learned counsel for the parties are ad idem that the present case is squarely covered by the judgment passed by Hon’ble Supreme Court in Punjab State Electricity Board and another Vs. Narata Singh and another : 2010 (4) SCC 317, wherein it has been held that the service rendered on the work charged basis is countable towards pensionary benefits.

Disposed of in the same terms as in Narata Singhs’ case (supra) with the directions to respondents No.1 & 2 to consider the claim of the petitioner for counting his work charged service from 03.07.1972 to 21.05.1985 for grant of pensionary benefits, within a period of three months from the date of receipt of certified copy of this
