Present revision petition has been filed under Article 227 of the Constitution of India challenging the orders dated 07.12.2017 and 21.03.2018 passed by the Trial Court and the First Appellate Court dismissing the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 filed with the plaint and the appeal, respectively.

Learned counsel for the parties are ad idem that now the suit is at the stage of evidence of the defendant-respondents and therefore stay order dated 06.07.2018 may be made absolute and the Trial Court may be directed to conclude the trial in a timebound manner.

In view of the above, the parties are directed to maintain status quo with regard to construction over the suit property and alienation thereof. The Trial Court is requested to expedite hearing of the trial and not to give any unnecessary adjournments to either of the parties.
