Though, the petitioner does not appear to be diligent in pursuing the proceedings before the learned executing Court, however, keeping in view the substantial interest of the parties and also the fact that denial of opportunity to lead evidence may prejudice the rights of the petitioner, the order dated 31.08.2018 passed by the learned executing court-cum-Additional District Judge, Ludhiana is hereby set aside. The petitioner is granted two effective opportunities to lead his entire evidence. However, the same shall be subject to cost of Rs. 50,000/- to be paid to the respondent-plaintiff on or before the next date of hearing before the learned executing court. 5.
