It is inter alia submitted by learned counsel for the petitioner that there were three civil suits pending between the parties For purposes of present Civil Revision, the relevant suits are: Suit No.207 of 2011 titled as “Mohinde Ramesh Puri and others” for declaration; of 2013 titled as “S. Sukhwinder Pal Singh vs. S. Joginder Sin another” for partition. It is submitted that however, the learned trial Court had passed the impugned order dated 24.9.2018 in the connected Civil Suit No.93011 of 2013 Joginder Singh and another”. It is submitted that on the short ground itself, the impugned order is not maintainable as the document Ex.DW2/A upon the part of the record of the civil suit No.207 of Learned counsel for the respondents is un the above said facts.
