2. Heard both sides.

In the instant application, a report has been filed by the Official Liquidator, wherein it has been indicated that the applicant, who is the debtor, has an outstanding amount of Rs.53,07,023.57/- payable, and verification of the records has also given a calculation of interest at various rates. However, this Court is of the considered view that, taking into consideration that the sum of Rs.12,82,362.42/- was due on and from 01.01.2017, and calculating interest at the rate of 8.5% per annum, which comes to Rs.10,46,681.48/-, and the Agreement Nos.2 and 7, the depreciated value which had been arrived at Rs.40,24,661.15/-, interest at the rate of 6% per annum on and from 01.02.2015 and 01.12.2015 respectively, an interest component of Rs.27,66,976.10/- is arrived. https://www.mhc.tn.gov.in/judis

4. In that regard, this Court is of the view that the applicant could be
directed to pay a sum of Rs.91,20,681.15/- (Rupees Ninety One Lakhs Twenty Thousand Six Hundred and Eighty One and Fifteen Paisa only), which is the principal plus interest, the 1st respondent is liable to pay and on such payment, the entire dues could be declared to have been settled.

Accordingly, the application stands disposed of with a direction to the 1st respondent to pay a sum of Rs.91,20,681.15/- (Rupees Ninety One Lakhs Twenty Thousand Six Hundred and Eighty One and Fifteen Paisa only) within a period of eight (8) weeks from the date of receipt of a copy of this order. On payment of such amount, the liability of the 1st respondent shall stand discharged. No costs.
