Learned counsel for the petitioner, after arguing for some time, prays for withdrawal of the present petition to take all pleas including that M/s Kukkar Trading Company, Arniwala from which the spurious seeds had been purchased by Daulatpuria Fertilizers, has been declared innocent, before the trial Court at the appropriate stage, in accordance with law, however, prays for exemption from personal appearance of petitioner, who is 59-years-old, suffering from various ailments and that he is ready to give an undertaking by way of affidavit and would present himself where his presence is absolutely necessary. 2. Dismissed as withdrawn with liberty aforesaid. 3. Petitioner is granted exemption from his personal appearance before the trial Court during pendency of the case, subject to his filing an affidavit before the Court concerned that he has no objection in case, the proceedings before it are held in his absence; in the presence of his counsel and shall appear before the said Court as and when his presence would be absolutely necessary.
