The present writ petition has been filed under Article 226 and 227 of the Constitution of India seeking issuance of an appropriate writ, order or direction for quashing the impugned order dated 28.08.2017 (Annexure P-8) whereby respondent No.1 has illegally appointed respondent No.3 as Arbitrator on the same reference between the same parties, on the same cause of action and subject matter, which has already been finally decided by this Court. 2. Learned counsel for the petitioner submitted that the impugned order dated 28.08.2017 (Annexure P-8) appointing a Sole Arbitrator, is ex facie illegal and is liable to be set aside. 3. Learned Senior Counsel appearing for the respondents submitted that he has no objection to the same. 4. In view of above, the present petition is allowed.
