Thereafter, it was brought to the notice of this Court that three Hon’ble Judges namely, the Hon’ble Mr.Justice N. Seshasayee, the Hon’ble Ms.Justice P.T.Asha and the Hon’ble Mr.Justice R.Sakthivel, have taken a different view holding that the deceased daughter cannot be treated as a coparcener and consequently, her legal heirs are not entitled to maintain a suit for partition by invoking the amended Section 6 of the Hindu Succession of Act. 2. Mr.S.Kaithamalai Kumaran, learned counsel for the respondents states that on this very issue, a Division Bench of this Court consisting of the Hon’ble Mr.Justice N.Sathish Kumar and the Hon’ble Mr.Justice M.Jothiraman, have heard the members of the bar and have reserved orders on 16.07.2026. 3. Hence, post this appeal after two weeks awaiting the orders of the Division Bench. 4.
