Heard the learned counsel on either side. 3. The learned counsel appearing for the petitioner submitted that the present writ petition has been filed challenging the order of attachment passed by the first respondent under Section 167 of the Tamil Nadu Co-operative Societies Act, 1983. Subsequently, the first respondent passed a surcharge order under Section 87(1) of the Act by proceedings dated 03.08.2020. 4. Challenging the said surcharge order, the petitioner filed W.P.(MD).No. 18934 of 2020. By order dated 25.04.2023, this Court relegated the petitioner to avail the statutory remedy before the appropriate appellate forum in the manner known to law. It is also submitted that W.P.(MD).No.21196 of 2023 has been filed by the respondent Bank challenging the order passed in favour of the petitioner and that an interim order of stay has been granted therein. 2/4 https://www.mhc.tn.gov.in/judis W.P.(MD)No.22090 of 2018 5. In view of the subsequent developments, particularly the passing of the surcharge order and the availability of an effective statutory remedy, this Court is not inclined to entertain the present writ petition challenging the attachment order. 6. Accordingly, the writ petition is disposed of granting liberty to the petitioner to work out his remedies before the appropriate forum, in the manner known to law. No costs.
