Heard both sides. 2.Admittedly, the petitioner herein suffered an eviction order under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 on
27.08.2018. Questioning the same, the petitioner filed an appeal before the District Collector under Section 10 of the Act on 31.08.2018. During the pendency of the said appeal, the impugned reminder calling upon the petitioner to vacate came to be issued. W.P(MD)No.23517 of 2018 3.This Court granted interim stay in favour of the petitioner. But we fail to understand as to why a grant of interim stay in this writ petition should have come in the way of the District Collector disposing of the appeal. We would expect the authorities under Section 10 of the Act to dispose of the appeals as expeditiously as possible. 4.The learned Government Advocate submitted that the second respondent will dispose of the appeal dated 31.08.2018 on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. It is needless to mention that till the disposal of the appeal, no coercive action can be taken against the petitioner. 5.This writ petition is disposed of accordingly. No costs.
