For Petitioner : Mr.S.Sankar (in both WPs) For Respondent : Mr.S.Dheenadhayalan, Standing Counsel (in both WPs) COMMON ORDER Challenging the impugned assessment orders dated 27.03.2018 and 31.03.2018, the present writ petitions have been filed by the petitioner. 2. The learned counsel appearing for the petitioner submitted that the respondent had issued the impugned final assessment orders alleging theft/unauthorised use of electricity, thereby determining a sum of Rs.2,29,115/- and Rs.2,39,465/- respectively, as payable by the petitioner to the respondent/TANGEDCO. Aggrieved by the said orders, the present writ petitions have been filed. 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)Nos.10695 and 10696 of 2018 3. The learned counsel further submitted that, during the pendency of these writ petitions, the petitioner had paid part of the assessed amounts. At present, the petitioner is liable to pay a sum of Rs.1,48,115/- and Rs.67,625/- respectively. It was, therefore, prayed that the petitioner may be permitted to pay the said amounts in installments. 4. The learned Standing Counsel appearing for the respondents/TANGEDCO, on instructions, submitted that in the event of default in payment of any one of the installments, the respondents may be permitted to proceed against the petitioner in accordance with law. 5.Heard the learned counsel for the parties and perused the materials available on record. 6. In view of the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, permits the petitioner to remit the respective balance demand amounts of Rs.1,48,115/- and 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)Nos.10695 and 10696 of 2018 Rs.67,625/- in five (5) equal monthly installments each, payable on or before the 7th day of every succeeding English calendar month. In the event of default in payment of any one of the installments, it is open to the respondent to proceed against the petitioner in accordance with law. 7. With the above directions, these Writ Petitions stand disposed of. No costs.
