The learned counsel appearing for the petitioner would submit that the petitioner made an application for electricity service connection. The same was rejected by the impugned order dated 03.04.2018 on the ground that a Second Appeal is pending before this Court. The learned counsel would submit that the mere pendency of the Second Appeal cannot be a ground to refuse electricity service connection. Electricity is an essential service and the pendency of a civil dispute does not disentitle the petitioner from obtaining such service. Therefore, the impugned order is liable to be set aside. Accordingly, he prayed for allowing the writ petition. 3. Per contra, learned Standing Counsel appearing for the respondent Electricity Board would submit that the title dispute between the parties is pending before this Court in the Second Appeal. If electricity service connection is granted to the petitioner, it may prejudice the rights of the contesting parties. Therefore, instead of filing the present writ petition, the petitioner ought to have filed an appropriate Civil Miscellaneous Petition in the pending Second Appeal seeking permission to obtain electricity service connection. Considering the rival submissions, this Court is of the view that the petitioner can work out his remedy in the pending Second Appeal. Hence, liberty is granted to the petitioner to file an appropriate CMP in the pending Second Appeal seeking electricity service connection. If such an application is filed, the same shall be considered on its own merits and in accordance with law. No costs.
