For Petitioner : Mr. K.R.Laxman (in both WPs) For R1 & R2 : Mr.R.Ramasamy, Counsel for State (in both WPs) COMMON ORDER Challenging the impugned order dated 04.05.2018, passed by the first respondent, the present writ petitions have been filed by the petitioner. 2. The case of the petitioners are that they were working as Accountant and Clerk in the respondent Society. Alleging certain irregularities, they were placed under suspension. Thereafter, the President of the Society conducted a disciplinary enquiry and imposed the punishment of stoppage of 3/7 https://www.mhc.tn.gov.in/judis W.P(MD)Nos.15604 and 15605 of 2018 increment for a period of three years. Consequential orders reinstating the petitioners into service were passed on 09.03.2018. However, the first respondent/Joint Registrar of Cooperative Societies initiated suo motu revision proceedings under Section 153 of the Tamil Nadu Cooperative Societies Act and by invoking the power under Section 153(3), suspended the operation of the President’s order. Challenging the same, the present writ petitions have been filed. 3. The learned counsel for the petitioners submitted that while entertaining the writ petitions, this Court granted an order of interim stay. By virtue of the said interim order, the petitioner in W.P.(MD) No. 15604 of 2018 continued in service and has since retired from service. The other petitioner in W.P.(MD) No. 15605 of 2018 is also continuing in service pursuant to the interim order passed by this Court. In the above circumstances, the learned counsel prayed that this Court may issue a direction to the first respondent/Joint Registrar to dispose of the suo motu revision proceedings within a time frame to be fixed by this Court and till then, the interim order granted by this Court may be continued. 4/7 https://www.mhc.tn.gov.in/judis W.P(MD)Nos.15604 and 15605 of 2018 4. The learned Counsel for the State, appearing for the respondents 1 and 2, submitted that he has no serious objection to the limited prayer sought for by the petitioners. 5. Accordingly, these writ petitions stand disposed of with a direction to the first respondent to dispose of the suo motu revision proceedings within a period of six weeks from the date of receipt of a copy of this order. The interim order granted by this Court shall continue till the disposal of the revision proceedings. No costs.
