In the counter affidavits and earlier status reports filed, there was a dispute in respect of stopping of dumping of garbage, which resulted in the order dated 09.04.2026 passed by this Court, which reads as follows:
“1. This Writ Petition is filed for issuance of a Writ of Mandamus, directing the Respondents 1 and 2 to stop dumping of garbage or any other waste materials, in Sulikadu, in SF.No.71/2 and 72, Animoor Village, Tiruchengode Taluk, Namakkal District. 2. Since the Respondents submitted that dumping of garbage was stopped after filing of the Writ Petition, which was denied by the Petitioner, this Court has directed the Respondents 1 and 2 to file status reports. Accordingly, the Respondents 1 and 2 have filed their individual status reports. The learned Additional Government Pleader also filed an Inspection Report of the District Collector, Namakkal. The Inspection Report filed by the District Collector, Namakkal is in tune with the report of the Commissioner, Tiruchengode Municipality. 3. The sum and substance of the status reports filed by the Respondents indicate that dumping of garbage in the said site had already been stopped. W.P.No.11199 of 2018 has not yet been removed completely. The Commissioner of the Tiruchengode Municipality has given an undertaking that the entire garbage and other waste materials will be removed by the end of May 2026. The said undertaking is recorded. 4. Post the matter on 2nd Week of June 2026 for further orders.”
3. In the order extracted above, it has been clearly stated that the entire dumping of garbage has been stopped, which has also been confirmed by the inspection carried out by the authorities. In respect of removing the garbage which has been dumped, based on the status report filed, time was given to the authorities to remove the same by the end of May, 2026. 4.
Today, when the writ petition is listed for hearing, learned counsel for Municipality, based on the written instructions, which is also confirmed by the Government Pleader, submits that earlier there were 71548 cubic meters of legacy waste and they have already removed 61955 cubic meters of waste and that though they have undertaken to remove the entire legacy waste by the end of May, 2026, due to impending rain, they were not able to remove it __________ https://www.mhc.tn.gov.in/judis
W.P.No.11199 of 2018 completely. However, it is submitted that remaining 9593 cubic meters of waste would be removed by the end of August, 2026. 5. Further, as per the report filed by the Commissioner, Tiruchengode Municipality, in a portion of the land reclaimed after removing the dumped waste, a Faecal Sludge Treatment Plant (FSTP) has been established and in another portion, Miyawaki forests have been developed and after completing removal of all legacy waste, trees would be planted throughout the entire area and it would be transformed into a natural dense forest. 6. In the light of the status report filed and in view of the fact that since more than 90% of the work has already been done and only 10% of the work to be done, which is undertaken to be completed and also considering the fact that the area would be converted and put to public use, we are inclined to direct the authorities to complete the process of removing the entire legacy waste by the end of August, 2026. __________ https://www.mhc.tn.gov.in/judis
