ORDER This Writ Petition has been filed challenging the proceedings of the 2nd respondent in R.No.061652/A3/2016, dated 27.12.2016, consequently confirmed by the 1st respondent in Appeal No.25 of 2017 dated 20.08.2018, quash the same and directing the 2nd Respondent to permit the petitioner to shift the present terminus from Tirupur Railway Station to Tirupur Old Bus Stand, in respect of Mini Bus bearing registration N.TN49 F 3033, flying on the route Tirupur Railway station to Nesavalar Colony. 2.The case of the petitioner is that he is the mini Bus permit holder of the mini bus bearing registration No.TN 49 F 3033 for the route Tirupur Railway Station to Nesavalar Colony via. 2nd Rly.Gate Palayakad, Goldennagar, Goundanaickenpalayam, Thottiamannarai Rly. Gate, Parapalayam, Kulathupalayampirivu, Nalroad, Kookipalayampirivu and Vavipalayam. He made an application before the 2nd respondent for shifting the terminus from Tirupur Railway Station to Tirupur Old Bus Stand in respect of the aforesaid mini bus and the same was rejected by the said authority vide order dated 27.12.2016, on the ground that the served sector exceeds the norms prescribed https://www.mhc.tn.gov.in/judis
WP No. 29114 of 2018 __________ Page3 of 5 in G.O.Ms.No.1532, Home (Transport III) Department , dated 17.11.1999, challenging which the petitioner filed an Appeal before the 1st respondent in Appeal No. 25 of 2017 and the 1st respondent also dismissed the Appeal filed by the petitioner vide order dated 20.08.2018,by confirming the order of the 2nd respondent and the said order is impugned in this Writ Petition.

The learned counsel appearing for the petitioner would submit that the respondents failed to consider the necessity of shifting of the terminus from Railway Station bus stop to Tirupur Old Bus Stand. However, he would submit that during the pendency of this Writ Petition Government had introduced the new scheme and this Court may direct the petitioner to make fresh application before the authority concerned as per the new scheme and the same may be
directed to be considered by the said authority.
4. The learned Government Counsel appearing for the 2nd respondent would submit that a direction may be issued to the petitioner to approach the authority concerned, seeking his request as per the new scheme.
5. In view of the aforesaid submission made by the learned counsel appearing on either side, this Court without interfering with the order impugned herein, permits the petitioner to approach the authority concerned for redressing his grievance, as per the new scheme introduced by the Government. https://www.mhc.tn.gov.in/judis
