The case of the petitioner is that he is the owner of the agricultural lands in S.Nos.22/2A and 22/2B measuring 1.35 acres and 0.85 acres respectively. The respondents 1 to 3 along with others tried to form a road in the petitioner’s agricultural lands on 04.09.2023. Therefore, the petitioner filed a suit in O.S.No.299 of 2013, before the District Munsif Court, Omalur, seeking permanent injunction against the respondents 1 to 3, in which the respondents 1 https://www.mhc.tn.gov.in/judis WP No. 26096 of 2018 __________ Page4 of 6 to 3 filed written statement stating that there is no proposal to form the road in the petitioner’s land and therefore the petitioner had withdrawn the said suit. While so, on 04.09.2018, the respondents 2 to 11 forcibly entered into the petitioner’s land and destroyed the sugarcane crops , bore wells, pipeline illegally, by threatening and assaulting the petitioner and his family members. Hence this petition. 3. The learned counsel for the petitioner would submit that a direction may be issued to the official respondents to conduct enquiry into the matter and restore the petitioner’s land. 4. The learned Government Counsel appearing for the respondents 1 to 3 would submit that the issue involved in this writ petition pertains to civil dispute between the petitioner and the private respondents and therefore the petitioner has to redress his grievance before the civil Court. He therefore prays for dismissal of this Writ Petition. 5. Heard both sides. Perused the records. 6. A perusal of the records clearly shows that the dispute pertains to civil dispute and therefore the petitioner has to agitate before the competent civil Court for redressing his grievance. https://www.mhc.tn.gov.in/judis WP No. 26096 of 2018 __________ Page5 of 6 7. In view of the same, this Writ petition is disposed of with liberty to the petitioner to approach the competent civil Court for appropriate remedy. No costs.
