JUDGMENT (Judgment of the Court was delivered by G.R.Swaminathan, J.) There are five appellants in this appeal. Mr.F.X.Eugene, the
learned counsel who entered appearance for the appellants 2 to 5 states that the clients have taken back the papers long back. The first appellant is represented by Mr.T.Amal Raj. He is also not present. 2.The learned counsel for the respondent states that this appeal arises out of a suit for specific performance and that sale deed was executed and delivery has also been taken and that the EP has also been terminated. Probably, that is why, the appellants are not interested in prosecuting this appeal. This appeal is dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is closed.
