During the course of arguments, Mr. Vachher, learned Senior Counsel for the appellants, submits that the appellants have alternate submissions with regard to the construction of the lift at another location and, in this regard, seeks to refer to lifts installed in other blocks at similar alternate locations. He, therefore, seeks liberty to approach the learned Trial Court in the first instance. 2. Learned counsels also assure the Court that they would not seek any adjournment. It is further agreed that the status reports filed by the MCD would also be placed before the learned Trial Court. 4. In view of the aforesaid, the present appeal, along with the pending applications, is disposed of. Needless to state, any observation made in any earlier order or in the present order shall not come in the way of either of the parties. 5. The parties further agree that the order of status quo shall continue for a further period of two months. The same shall, however, be without prejudice to the rights and contentions of the parties.
