1. After some initial submissions, learned counsel appearing for the petitioner submits that findings returned in the impugned Award, particularly the finding on Issue No. 1, whereby the Labour Court has held that it has no territorial jurisdiction to entertain the industrial dispute, be set aside.

Learned counsel submits that, though requisite documents were placed on record, however, despite abundant caution, he could not place certain additional documents on record. He submits that the management witness needs to be confronted with the same. However, since the management chose not to lead any evidence, the said documents could not This is a digitally signed order. Learned counsel appearing for respondent nos. 1, 3 and 4 also submits that certain documents in possession of the management, which would show that the petitioner was never employed in Delhi but at Bhiwandi, could not be placed on record.
4. Both the parties seek remand back of the matter to the Labour Court.
5. Considering the aforesaid submissions, this Court deems it appropriate to set aside the impugned Award in its entirety, as the primary finding in the Award pertains to Issue No. 1. The matter is remanded back to the concerned Labour Court, and all the issues framed be considered afresh, with liberty to both the parties to file additional documents. Further, both parties be granted an opportunity to lead evidence/cross-examine the witnesses. The parties are directed to appear before the concerned Labour Court on 01.09.2026.

At this stage, learned counsel for respondent no. 1, 3 and 4 submits that the said respondents have preferred an application seeking substitution of the respondents with Precon Technology and Castings Limited, in light of the Slump Sale Agreement dated 25.03.2013. Let the said application be also filed before the Labour Court, which may be considered in accordance with law.
7. Writ petition, along with pending applications, stands disposed of.
8. Let a copy of this order be communicated to the concerned Labour Court.
