CRL.M.A. 24946/2026 (additional documents)
1. By virtue of the present application, the petitioner seeks to place on record the relevant orders passed by the learned Trial Court. 2. Since the petitioner herein seeks to file Court orders which are a matter of record, the application is, for the reasons stated therein, allowed and the documents filed alongwith the same are taken on record. 3. As such, the application is disposed of. CRL.REV.P. 736/2018, CRL.M.A. 30849/2018 (for withdrawal)
4. This Court finds that vide order dated 26.02.2026, the learned Trial Court has recorded as under:-
“Record transpire that complainant has not been appearing since 31.5.2022. That Court notice was also issued on 03.6.24 same was unserved with the report that address is incorrect/ improper/ incomplete. That thereafter again court notice was issued upon complainant vide order dt. 17.3.25 This is a digitally signed order. which was received back as served. On LDOH, again court notice was issued upon the complainant. Notice received back as unserved with the report that no one resides at the given address. Record transpire that no other address available on record. Be awaited for complainant till 2pm. At 3:00p.m.
Despite providing several opportunities to complainant to appear and prosecute this matter, complainant has chosen not to appear. It is evidently clear that complainant does not wish to prosecute present matter. Accordingly, matter be dismissed in default for non prosecution.”
5. Considering the aforesaid, learned counsel for the petitioner submits that since the complaint before the learned Trial Court has itself been “…. …dismissed in default and for non-prosecution”, the present revision petition arising out of the order dated 28.07.2018 passed by the learned Trial Court in the said complaint has also become infructuous. She hence submits that the petitioner seeks to withdraw the present petition for which an application has also been moved herein. 6.
As such, in view thereof, the present petition is dismissed as withdrawn. SAURABH BANERJEE, J.
