The counsels are ad-idem that the issue involved is covered by the order dated 9-3-2017 passed by the Division Bench of this Court at Principal Seat in Writ Petition No. 10580/2015 (Sou. Revati Kusha Wagh and anr. Vs. The State of Maharashtra and anr.) along with connected writ petitions, by which the Court held that the Government Resolution dated 2-5-2012 would not apply to the appointment which was made from reserved category after following due procedure of law. 2. In the present case, it is not disputed that the petitioner was appointed from Scheduled Caste category and that the appointment was made following due procedure of law. In view thereof, impugned order dated 22-5-2018 passed by respondent no. 3- Deputy Director of Education, Nagpur Division, Nagpur refusing 2026:BHC-NAG:11932-DB Order wp 4374.2018.odt 2 to grant approval to the appointment of petitioner is quashed and set aside. 3.
