This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- “a. stay the eviction of residence and their belongings at T- Huts, Outram Line, G.T.B. It is the case of the petitioner that the petitioner is a Samiti of jhuggi dwellers having jhuggis at Outram Line, G.T.B. Nagar, Delhi, near Gurudwara Kingsway Camp. 3. Mr. Kamei, learned counsel for the petitioner, states that as per the policy of Delhi Urban Shelter Improvement Board (“DUSIB”) adopted by the Delhi Development Authority (“DDA”), the jhuggi dwellers having jhuggis prior to the cut-off date of 01.01.2015 are to be rehabilitated and only thereafter to be removed from their jhuggis. However, the petitioners are being threatened to vacate their jhuggis by several officials of the respondent authorities. Hence, the present petition. 4. Ms. Gupta, learned counsel for the respondent No. 1, states that in the present case, the DDA has already undertaken demolition action of jhuggis constructed illegally and unauthorisedly after 01.06.2014 and has also annexed a list along with the counter affidavit. The said demolition action was taken pursuant to the order dated 12.08.2016 passed in Cont. Cas(C) No. 466/2013. 5. She further states that in view of the judgment of Ajay Maken v. Union of India, 2019 SCC OnLine Del 7618, the DUSIB policy of rehabilitation is to be adopted by all the land owning agencies. This is a digitally signed order. In this view of the matter, present petition is disposed of with the following directions:- (i) As and when the respondents frame the plan for rehabilitation of jhuggi dwellers of the notified cluster (at Sr. No. 212 of the list) of Outram Line, G.T.B. Nagar, Delhi-110009 near Gurudwara Kingsway Camp, the eligible jhuggi dwellers shall be rehabilitated. (ii) In deciding the eligibility, only jhuggi dwellers eligible as per the policy (guidelines) being Delhi JJ slum Rehabilitation and Relocation Policy, 2015 will be considered. 7. Till the rehabilitation is done, the eligible jhuggi dwellers shall not be dispossessed. 8. The respondents shall ensure that due to the above order, there is no illegal encroachment or unauthorized construction and if any encroachment or illegal and unauthorized construction is made, the respondents shall be entitled to remove the same with the help of the respondent No. 3. 9.
