The present application has been filed on behalf of the plaintiffs under Order XXIII Rule 1 read with Section 151 of the Code of Civil Procedure, 1908 (“CPC”) for withdrawal of the present suit, along with an unconditional relinquishment and waiver of all rights, title and interest in the subject property bearing No. BN-91, West Shalimar Bagh, Delhi. 2. Learned counsel appearing for the plaintiffs submits that the plaintiffs, on their own accord and after due consideration, hereby unequivocally voluntarily and irrevocably declare that they have willingly given up their 1/3rd share in the subject property in favour of defendant nos. 1 to 3. Further, the plaintiffs now have no right, title, interest, share or claim of any nature This is a digitally signed order. Further, Power of Attorney holder Mrs. Ruchi Diwan of plaintiff nos. 3 to 5, is also present through VC and confirms the fact that plaintiff nos. 3 to 5 also, wish to withdraw the present suit. 4. Learned counsel appearing for the plaintiffs identifies the aforesaid persons. 5. Accordingly, considering the submissions made before this Court, the plaintiffs are permitted to withdraw the present suit. 6. The present suit is accordingly dismissed as withdrawn. 7. Pending applications also stand disposed of. 8. The next date of 27th April, 2026 before the Joint Registrar (Judicial), stands cancelled.
