1. Appellant has filed an appeal for reduction of the award dated 27.04.2018passed by the learned MACT awarding compensation of Rs.9,80,000/- along with interest @ 9% p.a. from the date of filing of the claim petition. On appeal, the insurance company deposited the entire awarded amount along with up-to-date interest with the Registrar General in terms of order dated 28.05.2018 and certain directions were issued permitting respondent 1 and 2 to withdraw the money from their saving bank accounts by means of a withdrawal form. We note that 50% of the awarded amount along with accrued interest directed to be released to the respondent nos. 1 and 2 in terms of award of the Tribunal. 2. We have interacted with the learned counsel for the appellant. Apropos such interaction and deliberation, learned counsel for the This is a digitally signed order. appellant wishes to withdraw the present appeal. 3. We permit the appellant to withdraw the appeal subject to the condition that the legal rights of the claimant shall stand protected. 4. In terms thereof, the Registrar General of this Court may release the balance awarded amount along with accrued interest, if not released, in favour of the respondents 1 and 2 as per the proportions detailed in the award of the ld. Tribunal subject to the compliance of all the requisite formalities. 5. Needless to say that the appellant shall be entitled to refund of the statutory amount along with interest and direction is issued to release the same. 6. In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of. 7. A copy of this order be also sent to the respondent (s)-claimant (s).
