Learned counsel for the petitioner, referring to the statement made in paragraph 4 of the restoration petition, submits that on the date fixed for consideration of the second appeal, i.e., 06.04.2010, the learned counsel entrusted to conduct the case could not ensure his presence, and for want of prosecution, the second appeal was dismissed. 3. It has next been submitted that the appellants, who had preferred the second appeal, are poor and illiterate persons; therefore, they were unable to properly monitor case and its proceedings, and consequently, the order dismissing the second appeal for want of prosecution came to be passed. 4. For the reasons explained / mentioned in this restoration petition, the Second Appeal No.252 of 2007 is restored to its original file. 5.
