JUSTICE SANDEEP KUMAR ORAL ORDER 4 23-07-2026 Heard the learned counsel for the petitioner and the learned counsel for the State. 2. The present application has been filed for cancellation of the bail granted to Opposite Party No. 2 by the learned Chief Judicial Magistrate, Buxar, vide order dated 10.09.2018, in connection with Brahampur P.S. Case No. 206 of 2018, registered under Sections 420, 406, 467, and 468 of the Indian Penal Code. 3. From the records, it appears that the impugned order granting bail to Opposite Party No. 2 has been passed by the Chief Judicial Magistrate, Buxar. However, the said order has not been assailed before the learned Principal District & Patna High Court CR. MISC. No.78481 of 2018(4) dt.23-07-2026 2/2 Sessions Judge, Buxar. 4. In these circumstances, this application is disposed of with liberty to the petitioner to file an appropriate application seeking cancellation of bail granted to the O.P. No. 2 before the Principal District & Sessions Judge, Buxar. If such an application is filed, the learned Principal District & Sessions Judge, Buxar shall consider and dispose of the same on its own merits, in accordance with law, preferably within a period of three months from the date of its filing. 6. It is made clear that this Court has not expressed any opinion on the merits of the rival claims and all questions are left open to be considered by the learned Principal District & Sessions Judge, Buxar. 7.
