The present petition has been preferred: “to initiate contempt proceeding against the opposite parties for disobeying the order dated 01.05.2018 passed by the Hon’ble Court in CWJC No. 8096 of 2016.” Patna High Court MJC No.4355 of 2018(5) dt.25-06-2026 2/3 3. The Writ Court on the submissions of the petitioner vide an order dated 01.05.2018 directed the respondents to look into his case and if he is found owner of the acquired land, necessary compensation to be paid. 4. By way of contempt petition, the petitioner claims that the order has not been complied. 5. A show cause has come on behalf of the opposite party nos. 2 to 5 according to which notice was issued to the petitioner vide memo no. 821 dated 31.12.2018 and this was followed by memo no. 15 dated 17.01.2019. 6. Though he submitted his papers on 03.03.2019 and claimed ownership over the land, the petitioner failed to submit Land Possession Certificate and/or rent receipt as a result whereof, the opposite parties ultimately sent the matter to the Presiding Officer, Land Acquisition Officer, Rehabilitation and Resettlement Authority, Muzaffarpur, (henceforth for short ‘the LARRA’) under section 64/76/77 of the Land Acquisition Act, 2013. 7. Learned counsel for the petitioner submits that the order of the Writ Court was not complied in toto. 8. Learned State counsel submits that when the petitioner failed to submit his land possession certificate, Patna High Court MJC No.4355 of 2018(5) dt.25-06-2026 3/3 naturally, the matter was referred to ‘the LARRA’. 9. Having heard the parties and perusing the records, the aforesaid facts clearly show that the opposite parties have acted bonafidely. The petitioner failed to produce the document but still he has opportunity to submit the papers before ‘the LARRA’ so that an appropriate order can be passed. No contempt is made out. 10.
