WA NO. 8/2018 (LA - BDA) IN THE HIGH COURT OF KARNATAKA AT BENGALURU [BANGALORE DEVELOPMENT AUTHORITY AND ANOTHER VS. SRI D M JAGADISH AND ANOTHER] 16.04.2026 (VIDEO CONFERENCING / PHYSICAL HEARING) CORAM: HON'BLE MR. JUSTICE JAYANT BANERJI and HON'BLE MR. JUSTICE RAJESH RAI K ORAL ORDER (PER: HON'BLE MR. JUSTICE JAYANT BANERJI) Learned Counsel for the appellants is present. No one appears for respondent No.1. Learned AGA appears for the State/respondent No.2. When the matter was last listed on 25.03.2026, the following order was passed: “Learned counsel for private respondent No.1 is seeking an adjournment to enable him to complete his instructions. As prayed, list this matter on 16.04.2026 with the understanding that the matter may not be adjourned when it is listed next.” Today, it is noted that on 15.04.2026, a memo of retirement has been filed enclosing therewith a letter dated 14.04.2026 signed by the advocate on record to respondent No.1 in which it is stated that for the past two months, instructions are being sought from respondent No.1. Digitally signed by KAVYA G Location: High Court of Karnataka - 2 - WA NO. 8/2018 (LA - BDA) But he is avoiding the calls of the Counsel. The party was therefore called upon to make necessary arrangement to collect the NOC vakalat from the learned Counsel. Since this letter has been apparently sent through registered post and dispatched on 15.04.2026, we adjourn the matter to 04.06.2026 on which date this matter would be taken up and no adjournment would be granted. Office is directed to communicate this order to respondent No.1. List on 04.06.2026. (JAYANT BANERJI) JUDGE (RAJESH RAI K) JUDGE KSR List No.: 2 Sl No.: 1
