The instant contempt petition arises out of the order/judgment passed by the learned Writ Court dated 28.11.2017 in SWP No. 971/2017 by virtue of which the writ petition preferred by the petitioners was disposed of with a direction to the respondents-department to take a final decision on the tentative seniority list based on the objections received from all concerned within the period of eight to ten weeks from the date of receipt of copy of the order. Besides the petitioner was also granted liberty to make a representation to the respondent-department within ten days. 02. The respondents have filed a detailed statement of facts/compliance report, wherein they have taken a specific stand that the Government has issued Government Order No. 76-SW of 2019 dated 28.02.2019, whereby it has been provided that the seniority of Anganwari Workers who acquire higher qualifications during the course of their service shall be reckoned from the Sr. No. 218 2 CPSW No. 348/2018, date of acquiring of such higher qualification, instead of from the date of their initial appointment. The respondents while filing the detailed compliance report have also placed on record the aforesaid Government order evidencing the factum of said decision. The respondents have further submitted in the compliance report that the aforesaid Government order, by virtue of which the issue of seniority stands clinched, was already subject matter of SWP No. 840/2019 in which the Court has already stayed the operation of aforesaid Government order. A copy of stay has also been placed on record of the aforesaid compliance report. 03. At this stage, Mr. Singh, further submits that the rider imposed by this Court in the aforesaid petition has already been lifted, as the order of stay granted by this Court dated 30.04.2019 in SWP No. 840/2019 has ceased to operate consequent upon dismissal of the said writ petition vide order dated 16.07.2025. 04. Thus, in the light of the aforesaid development, the said Government order dated 28.02.2019 has been revived, therefore, there is no impediment that the fruits of the aforesaid order be not extended to the petitioners. The learned counsel appearing on behalf of the respondents submits that the order/judgment passed by the learned Writ Court with the issuance of the Government order and also in the light of the vacation of the stay order, stands implemented. 05. Accordingly, I am in agreement with the arguments advanced by learned counsel for the respondents that the order/judgment passed by the learned Writ Court by issuance of the Government order stand complied with, 3 CPSW No. 348/2018, therefore, no purpose would be served to keep the instant contempt petition alive. 06. In view of the aforesaid backdrop, the proceedings in the contempt petition are closed. Rule, if any, stand discharged. Contempt petition stands disposed of.
