By this petition, the petitioners seeks initiation of contempt proceedings against the respondents for willful disobedience and non-compliance of the judgment dated 02.08.2018 passed by this Court in SWP No. 1788/2018 titled as Nasir-ul-Rasheed Rather & Ors. Vs Union of India & Ors whereby this Court has disposed of the writ petition with a direction to the respondent Nos. 2 and 3 in the petition to convene the Departmental Promotion Committee and consider the petitioners for promotion to the available posts of Assistant Director (Administration and Co-ordination) in accordance with the Recruitment Rules in vogue and also in the light of Office Memorandum No. 22011/1/2011-Estt(D) dated 11.03.2011.
On being put on notice, the respondents have filed their response and it is submitted that in compliance of the judgment passed by this Court, the respondents have convened the Departmental Promotion Committee (DPC) and have accorded promotion to the petitioners to the post of Assistant Directors (A&C).
Learned counsel for the petitioners submits that though the respondents have complied with the judgment and promoted the petitioners to the

post of Assistant Director yet the petitioners would be entitled to promotion from the date they acquired eligibility under the un-amended rules.
Having considered the submission made by learned counsel for the petitioner, I am of the considered opinion that the judgment passed by this Court dated 02.08.2018 (ibid.) has been substantially complied with and there is no reason to proceed against the respondents in the contempt proceedings.
The dispute which the learned counsel for the petitioners is raising could be a subject matter of the challenge in an independent proceedings.
In view of the aforesaid, the proceedings in this contempt petition are closed, leaving it open to the petitioners to work out their remedy in accordance with law.
Disposed of.
