HIRDESH KUMAR , COMMISSIONER SECY. , P.D.D ...Respondent(s) Through: Ms. Salika Sheikh, Assisting Counsel vice Mr. Raman Sharma, AAG CORAM: HON’BLE THE CHIEF JUSTICE O R D E R 15-05-2026 Vide this petition, the petitioner seeks initiation of the contempt proceedings against the respondent authorities for willful/deliberate defiance of the order dated 28.07.2017, rendered by the writ court SWP No. 1856/2017 (Vikram Jeet Singh Vs. State and Anr.). A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of by the writ court with a direction to the respondent authorities that in the event, they decide to make promotions against the post of Executive Engineer, the same be done strictly in accordance with the Rules governing the field and as per SRO 14 of 2016 dated 15.01.2016. Compliance report on behalf of respondents has been filed. And per the averments set out in para 05 thereof, the claim of the petitioner was considered by the respondent authorities in the right earnest and rejected vide the speaking order dated 05.01.2022 (Annexure-C1): 5. “That in compliance to the directions of Hon'ble Court dated 20-09-2017, the respondent department examined the case of the petitioner and after giving thoughtful consideration to the claim of the petitioner viz-a- viz court directions/relevant records and rules governing the subject, it was observed that the Power Development Department has adopted and followed the Jammu Engineering (Gazetted) Service Recruitment Rules, 1978 notified vide SRO-380 of 1978, read with amendments made Aadil Hussian Bhat I attest to the accuracy and authenticity of this document vide SRO-209/1992 and SRO 297/2006 notified by the PW(R&B) Department. It is relevant to mention here that the SRO-14 of 2016 dated 15-01- 2016 has been issued by the PHE/I&FC Department (Now Jal Shakti Department) as an amendment to the Jammu and Kashmir Engineering (Gazetted) Service Recruitment Rules, 1978 as amended vide SRO 297 of 2006 dated 14-09-2006 of the Public Works Department being adopted by that Department, as per convenience of that Department for cadre management. The said amendment has not been adopted/issued by the Power Development Department in the Gazetted Service Recruitment Rules or the PW(R&B) Department. That in view of the fact that said amendment has no application to the employees of the Power Development Department, as such, the claim of the petitioner has been found without any merit and hence rejected vide Govt. Order No. 01- JK(PDD) of 2022 dated 05-01- 2022. A copy of which is enclosed herewith as Annexure-C 1.” In the wake of the above, nothing substantive survives in the petition and same is disposed of as such.
